These Terms of Use (the "Terms") are a binding agreement between Selvyo sp. z o.o. ("Selvyo", "we", "us") and you (the "User", "you").
By accessing or using any part of the Website (defined in Section 3), you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Website.
If you act on behalf of a legal entity, you represent and warrant that you are authorized to bind that entity.

3.3 In case of conflict between these Terms and a more specific document (API Terms of Service, Order Form, MSA, DPA), the more specific document prevails to the extent of the inconsistency.
4.1 The Website is intended for users who are at least 16 years of age (or the higher age of digital consent under local law where applicable). If you are below that age, you must not use the Website.
4.2 The Services are business-to-business (B2B). The Website is directed to professionals evaluating or operating the Services on behalf of a business. The Website is not a consumer offering within the meaning of Article 22¹ of the Polish Civil Code, and we do not knowingly contract with consumers via the Website for paid Services.
4.3 You must not use the Website if you are located in, organized under the laws of, or ordinarily resident in any country or territory subject to comprehensive EU, UK, US, or UN sanctions, or if you are on a restricted-party or denied-party list.
5.1 You may browse the Website without an account. Certain features (the dashboard, the demo/sandbox, support tickets, newsletter, blog comments where enabled) may require account registration or contact details.
5.2 You agree to provide accurate, complete, and current information when registering or submitting forms, and to keep it up to date.
5.3 You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at sergiydf2025@gmail.com if you suspect unauthorized use.
5.4 We may suspend or terminate accounts that breach these Terms, the API Terms of Service, applicable law, or that show signs of fraudulent or abusive activity.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Website for the following purposes:

8.1 The Website, including all text, graphics, code, design, layout, logos, trademarks, documentation, illustrations, audio, video, data, and software components (collectively, the "Website Content"), is owned by or licensed to Selvyo and is protected by Polish, EU, and international intellectual-property laws.
8.2 Except as expressly permitted in Section 6 or elsewhere in these Terms, no rights to the Website Content are granted to you. All rights not expressly granted are reserved.
8.3 Trademarks. "Selvyo", "Selvyo.io", and our logos and product names are trademarks of Selvyo. You may not use them without our prior written consent, except for fair, descriptive references in accordance with applicable law.
8.4 Limited documentation license. You may, internally within your organization, view, store, and print reasonable extracts of our documentation solely to evaluate or use the Services. You must retain all proprietary notices.
8.5 Code samples. Code samples published in our documentation are made available under the license stated next to them (typically a permissive open-source license — e.g., MIT). If no license is stated, they may be used internally for evaluation only.
8.6 Third-party content. Some content on the Website (e.g., third-party logos for customer references, open-source libraries) belongs to third parties and is used with permission or under license. Such content is subject to its own terms.
9.1 The Website may invite you to submit content (form messages, demo-data, blog comments where enabled, support questions, feedback, job applications). Collectively "User Content".
9.2 You retain ownership of User Content you submit. You grant Selvyo a worldwide, royalty-free, perpetual, irrevocable, sublicensable, transferable license to use, host, store, reproduce, modify, create derivative works of, communicate, publish, publicly perform, publicly display, and distribute the User Content for the purposes of operating and improving the Website and the Services, responding to your request, and exercising our rights under these Terms.
9.3 Feedback. If you submit suggestions, ideas, feature requests, bug reports, or other feedback, we may use them without restriction or compensation. The license is perpetual, irrevocable, worldwide, royalty-free, fully paid-up, sublicensable.
9.4 You represent and warrant that:
9.5 We have no obligation to monitor User Content but may remove or refuse to publish any User Content at our discretion. We may report unlawful content to competent authorities.
10.1 We may offer a public demo or a sandbox environment to let you try food-recognition features without registering for the paid API.
10.2 The demo / sandbox is provided "AS IS" for non-commercial evaluation. Rate limits apply. Output is for illustrative purposes only and is not warranted for accuracy or suitability for any particular purpose.
10.3 You must not submit through the demo / sandbox:
10.4 Without prejudice to our Privacy Policy, by submitting data to the demo / sandbox you confirm that we may process it solely to generate the demo Output and to operate, secure, and improve the demo. Inputs are deleted within twenty-four (24) hours.
10.5 Commercial use of the demo / sandbox, including integration into a production application, is prohibited. Commercial use requires the paid API and acceptance of the API Terms of Service.
The Website may link to third-party websites or embed third-party services (e.g., open-source repositories, integration partners, social media). We do not control and are not responsible for third-party content, practices, or terms. Your use of third-party services is at your own risk and subject to those parties' terms and privacy policies.
12.1 We aim to keep the Website available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Website (or any part of it) at any time, with or without notice.
12.2 The Website is not the Services. Availability commitments for the paid API (uptime SLA, scheduled-maintenance windows) are set out in the API Terms of Service, not here.
12.3 We may update Website Content (pricing pages, documentation, blog posts) at any time. The version on the Website at the time you access it supersedes earlier versions, except where a specific page indicates otherwise (e.g., versioned API documentation).
13.1 To the maximum extent permitted by applicable law, the Website and all Website Content are provided "AS IS" and "AS AVAILABLE", with all faults and without warranty of any kind, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, or uninterrupted operation.
13.2 Without limiting Section 13.1:
14.1 To the maximum extent permitted by applicable law, in no event shall Selvyo be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, anticipated savings, or data, arising out of or in connection with your access to or use of the Website, whether based on contract, tort (including negligence), statute, or otherwise, even if we have been advised of the possibility of such damages.
14.2 To the maximum extent permitted by applicable law, our total aggregate liability arising out of or in connection with the Website shall not exceed one hundred US Dollars (USD 100).
14.3 The exclusions and limitations in Sections 14.1 and 14.2 do not apply to:
14.4 If you use the paid API or SDK, your relationship with us in respect of those services is governed by the API Terms of Service and the limitation-of-liability provisions in that agreement apply to those services.
To the extent permitted by law, you shall defend, indemnify, and hold harmless Selvyo and its affiliates, and their respective officers, directors, employees, and agents, from and against any third-party claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
16.1 We may suspend, restrict, or terminate your access to the Website at any time, with or without notice, including where we reasonably believe you have breached these Terms or applicable law.
16.2 You may stop using the Website at any time. Sections that by their nature should survive termination — including 8 (IP), 9 (User Content & Feedback license), 13 (Disclaimer), 14 (Limitation), 15 (Indemnification), 20 (Governing Law & Disputes), and 21 (General Provisions) — shall survive.
17.1 If you believe that content on the Website infringes your intellectual-property rights or is otherwise unlawful, send a written notice to sergiydf2025@gmail.com including:
17.2 We will review notices and respond consistently with applicable law, including the Digital Services Act (Regulation (EU) 2022/2065) where applicable. We may forward notices and counter-notices between the parties involved.
Our processing of Personal Data in connection with the Website is described in the Privacy Policy. Our use of cookies and similar technologies is described in the Cookies Policy. Both documents form part of these Terms by reference.
You represent and warrant that you are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to comprehensive EU, UK, US, or UN sanctions, and that you are not on any restricted-party or denied-party list. You shall not access or use the Website in violation of applicable export-control or sanctions laws.
20.1 These Terms, and any non-contractual obligations arising out of or in connection with them, are governed by the laws of the Republic of Poland, excluding its conflict-of-law rules and the United Nations Convention on Contracts for the International Sale of Goods.
20.2 The Parties shall first attempt to resolve any dispute through good-faith negotiation. If the dispute is not resolved within thirty (30) days of written notice, either Party may submit the dispute to the exclusive jurisdiction of the common courts of the Republic of Poland having jurisdiction over the seat of Selvyo (Warsaw).
20.3 Nothing in this Section limits any non-waivable consumer-protection rights you may have under your local mandatory law if, despite Section 4.2, these Terms are deemed to apply to you as a consumer.
21.1 Entire agreement. These Terms, together with the Privacy Policy, the Cookies Policy, and (where applicable) the API Terms of Service, DPA, and any Order Form or MSA, constitute the entire agreement between you and Selvyo with respect to the Website and supersede all prior or contemporaneous communications and proposals.
21.2 Changes. We may update these Terms from time to time. We will revise the "Last Updated" date and, for material changes, give reasonable advance notice via a banner on the Website. Continued use of the Website after the effective date constitutes acceptance.
21.3 Severability. If any provision is held invalid or unenforceable, it shall be reformed to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
21.4 Waiver. No failure or delay in exercising any right constitutes a waiver. Any waiver must be in writing.
21.5 Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets.
21.6 Force majeure. We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemic, government action, sanctions, labor disputes, cyberattacks not caused by our negligence, public-utility or telecommunications failures, failures of upstream cloud-infrastructure providers (including AWS), and changes in law.
21.7 No third-party beneficiaries. These Terms are for your benefit and ours; they do not create rights enforceable by any third party.
21.8 Notices. Notices to Selvyo shall be sent by email to sergiydf2025@gmail.com. We may give notice to you via email (where on file), via your account, or via the Website.
21.9 Language. The authoritative language of these Terms is English. A Polish translation may be provided for convenience; in case of inconsistency, the English version prevails, except where mandatory Polish law requires otherwise.
